ALTERNATIVE DISPUTE RESOLUTION (ADR) SKILLS COURSE - 3 DAYS
This workshop gives participants the skills they need to manage conflict. It encompasses all the material we cover in our Negotiation Course and the more basic aspects of our Mediation Course. Participants learn how to prevent conflicts from spiraling into costly disputes and how to resolve disputes quickly, efficiently and in a cost effective way. Here are some of the things we cover in this workshop:

- Interests and how they fit in
- Identifying and using Best Alternatives to a Negotiated Agreement (BATNA’s)
- Getting into and concentrating on the zone of potential agreement

- The role of relationship
- Putting together a winning strategy
- Process options
- Structuring an effective negotiation
- Structuring an effective mediation or facilitation process
- Acting in the role of a facilitator or mediator
- Techniques, tactics and approaches used by negotiators
- Techniques and approaches used by mediators and facilitators
- Setting reasonable and achievable goals
- Effective communication strategies and techniques
- Getting and papering commitment
- Dealing with difficult people and difficult situations
- Honesty and dishonesty in dispute resolution
- Dealing with challenging tactics being employed by others

ADVANCED ALTERNATIVE DISPUTE RESOLUTION (ADR) SKILLS COURSE - 3 DAYS
This workshop is offered to those that have been introduced to the concepts covered in the Alternative Dispute Resolution (ADR) Course. It encompasses the advanced mediation and facilitation techniques, skills and approaches we cover in our Mediation Course. Participants hone the skills they learned in the Alternative Dispute Resolution (ADR) Skills Course and explore new and more complex approaches, skills and issues. Here are some of the things we cover in this workshop:
- Advanced mediation and facilitation techniques for breaking log jams
- Advanced approaches to dealing with challenging people, situations, tactics and dynamics
- Advanced approaches to getting the other side to engage in dispute resolution
- Power imbalances
- Framing issues
- Facing challenges to independence and neutrality
- Reality testing
- The role of advisers (lawyers, the supervisor of a party in a workplace mediation etc...)
- Multi-party and multi-issue dynamics and techniques
- Reframing damaging statements
- Advanced issues regarding caucusing
- Ethical complexities in mediation and facilitation
- Adapting facilitation and mediation to the circumstances of the parties and the dispute
- Adapting facilitation and mediation to situations where the mediator or facilitator is not neutral or independent (such as where a managers acts as a mediator or facilitator to resolve disputes between employees)
